On October 22, 2026, the U.S. Food and Drug Administration (FDA) officially published its finalized policy document titled “Questions and Answers Regarding Mandatory Cosmetics Recalls: Guidance for Industry”.

This publication represents a key component of FDA’s continuous efforts to enforce the provisions established by the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). Specifically, the document provides comprehensive clarity on the FDA’s new authority to demand mandatory recalls for cosmetic products, a regulatory power formally granted under section 611 of the Federal Food, Drug, and Cosmetic Act (FD&C Act).

After evaluating public feedback submitted on the initial draft released on December 18, 2025, the FDA opted to finalize the guidance without making any substantive modifications. The finalized guidance serves as a critical operational framework for the beauty and personal care industry by detailing three primary areas of focus:

  • The specific criteria and conditions under which the FDA possesses the authority to issue a mandatory recall order.
  • The exact procedural steps the agency will execute when enforcing a mandatory recall action.
  • The strict expectations placed upon the industry to ensure full compliance with these mandatory regulatory directives.

Despite the crystallization of these mandatory enforcement powers, the FDA explicitly notes that it still strongly urges companies to proactively execute voluntary recalls whenever violative or unsafe cosmetic merchandise is identified in the supply chain.
