On September 30, 2026, the US Senate introduced S 5674, the Recycled Materials Attribution Act of 2026, which proposes establishing federal standards for recycled-content claims in consumer products. For consumer products manufacturers, the bill could affect environmental marketing claims relating to product packaging and recycled materials used in manufacturing. It would recognize mass balance accounting as an acceptable method of substantiating recycled-content claims, provided an independent third-party certification system is followed, and claims are supported by competent and reliable scientific evidence. The bill would also require the Federal Trade Commission to update its Green Guides within one year of enactment and establish federal enforcement provisions for misleading claims, while preempting certain state and local requirements within its scope.
