With the upcoming deadline for complying with MoCRA requirements quickly approaching, it is important for beauty brands to undertake certain actions in order to be prepared. A few changes that MoCRA necessitates include mandatory registration of cosmetic facilities with the FDA, mandatory listing of cosmetic products, ensuring proper processes in place for receipt and communication of any serious adverse events reported by consumers to the FDA, and maintenance of documentation to support the safety of their products. Failure to do comply could lead to mandatory recalls, criminal action, facility shutdowns, fines or penalties for noncompliance.

At this time the FDA has yet to release final guidance to enable industry to comply with the new requirements. Nonetheless, companies should get prepared to provide the needed information to the FDA and update labels accordingly.
