]]> New Mexico is poised to make a significant move as the first jurisdiction to impose comprehensive labeling requirements on ALL products containing intentionally added PFAS.

The New Mexico Environment Department (NMED) has announced plans for an unprecedented rule, effective January 1, 2027. This means if your product contains intentionally added per- and polyflouroalkyl substances, you’ll need to label it accordingly.

Key Dates & Details:

  • January 1, 2027: Labeling requirements for intentionally added PFAS take effect.
  • 2027: Reporting requirement applicable to all products containing intentionally added PFAS begins.
  • 2032: Restriction on products containing intentionally added PFAS comes into force

While there’s a blanket exemption for used products, manufacturers may be able to seek exemptions if they can demonstrate no direct consumer contact with PFAS in their product.

This initiative highlights a growing global focus on transparency and consumer safety regrading ‘forever chemicals’. Manufacturers should start evaluating their product formulations and supply chains now to ensure compliance.
